THIS IS A RELEASE OF LIABILITY - DO NOT CHECK BOX UNLESS YOU AGREE TO BE BOUND BY ITS TERMS
By checking this box, I agree to electronically signing this RELEASE OF LIABILITY AND INDEMNITY AGREEMENT, I am acknowledging that I or my child (collectively referred to as "I" or "my") have chosen to participate in water sports activities, and/orother recreational activities, including butnot limited to kayaking, paddling, kayak fishing, swimming, snorkeling, scuba diving,
freediving, spearfishing, with or without the use of a kayak, and all other water sports
(hereinafter collectively referred to as "sport") with or through AQUAHUNTERS KAYAK FISHING AND
ECO TOURS AND AQUA HUNTERS CLUB, AQUAHUNTERS TOURNAMENTS and INNOVATIVE INTERNET & MEDIA SOULUTIONS< LLC . 
I understand that my participation in the sport poses risks of INJURY and/or DEATH to me. These risks include, but are not limited to, drowning, near drowning, the lack of immediate emergency and/or medical attention inthe event of injury and/or an emergency, the encounter of and variations in water and/or marine conditions, including, but not limited to, variations in tides, surf, swell, surge, waves, current and/or wind conditions, inclement weather, use and/or transport of equipment, including rental equipment, such as kayaks, paddles, marine electronics,
communication devices, fishing tackle, fishing supplies, personal floatation devices,
loss of control, encounters and/or collisions with other kayakers and/or theirequipment, boats, marine vessels and/or water craft of any type such as jetskis, wetbikes, surfboards, or any other vessel/vehicle and/or water craft, reefs, pinnacles, rocks and/or any structures above and below the surface of the water, visible or not, known or unknown, debris of any sort, manmade and/or natural obstacles whether they are obvious and/ or known and/or observable or not. I further understand thatother risks also include various marine plant
and/or animal life, including, but notlimited to sharks of any species, rays, various species of fish,
including those that are
or may be venomous and/or poisonous whether through their bite, spines orotherwise, whales, dolphin,
porpoise, seals, sea lions, jellyfish including those that are
or may be venomous and/or poisonous, kelp, kelp paddies, kelp forests, and/or seaweeds.
Despite the risks involved, and in consideration of the right to participate in the sport, IAGREE TO
EXPRESSLY ASSUME ALL RISKS OF INJURY OR DEATH that might beassociated and/or that might
occur, with my participation in the sport and/or any useand/or transport of any equipment and/or gear
associated with my participation in thesport whether provided by me or by AQUA HUNTERS KAYAK
FISHING AND GUIDING
SERVICES AND AQUA HUNTERS CLUB and AQUA HUNTERS TOURNAMENTS,
including, but not limited to all risks of injury and/or death associated with kayaking,
paddling, kayak fishing, swimming, snorkeling, scuba diving, freediving, spearfishing,
with or without the use of a kayak, launching and/or landing a kayak whether throughsurf, waves, swell
and/or wind, from and/or to any beach, harbor, cove, and/or jetty, aswell as participation in any kayaking,
paddling, and/or kayak fishing instruction,
seminar, clinic, tournament, race and/or special event by and/or through AQUAHUNTERS KAYAK
FISHING AND GUIDING SERVICES AND AQUA HUNTERS CLUBand AQUA HUNTERS
TOURNAMENTS, its owners, officers, agents, employees,
contractors, sponsors, and/or affiliated companies, as well as transportation of any
kayak and/or fishing related gear to or from any location (hereinafter collectively
referred to as "activities").

I further understand that during my participation in the sport and/or any use and/ortransport of any
equipment and/or gear associated with my participation in the sportwhether provided by me or by AQUA
HUNTERS KAYAK FISHING AND GUIDINGSERVICES AND AQUA HUNTERS CLUB and AQUA
HUNTERS TOURNAMENTS, aswell as my engagement in any of the activities, I may encounter various
man-made/
involved and/or natural conditions/features. I understand that in my participation in thesport and
engagement of the activities, I must inspect the elements and/or conditionsand/or features I encounter
and evaluate the risks and degree of difficulty before
participating. I understand that throughout the day, conditions and/or elements and/orfeatures including,
but not limited to variations in water and/or marine conditions,
including, but not limited to, variations in tides, surf, swell, surge, waves, current and/orwind conditions,
will change. I AGREE TO EXPRESSLY ASSUME ALL RISKS OFINJURY AND/OR DEATH associated
with such conditions and/or elements and/orfeatures, and AGREE TO BE SOLELY RESPONSIBLE for
knowing and understandingmy ability to encounter all such conditions and/or elements and/or features.
In consideration for my participation in the sport and/or any use and/or transport of anyequipment and/or
gear associated with my participation in the sport whether providedby me or by AQUA HUNTERS KAYAK
FISHING AND GUIDING SERVICES ANDAQUA HUNTERS CLUB and AQUA HUNTERS
TOURNAMENTS, as well as myengagement in any of the activities, I AGREE TO RELEASE FROM ANY
LEGALLIABILITY AND AGREE NEVER TO SUE AND/OR COMMENCE ANY LEGAL ACTIONAND/OR
PROCEEDING against AQUA HUNTERS KAYAK FISHING AND GUIDINGSERVICES AND AQUA
HUNTERS CLUB and AQUA HUNTERS TOURNAMENTS, itsowners, officers, agents, employees,
contractors, sponsors, and/or affiliated
companies, for any injury and/or death resulting from my participation in the sport and/
or any use and/or transport of any equipment and/or gear associated with myengagement and/or
participation in the sport, whether provided by me or by AQUAHUNTERS KAYAK FISHING AND
GUIDING SERVICES AND AQUA HUNTERS CLUBand AQUA HUNTERS TOURNAMENTS, and further
AGREE TO RELEASE FROMANY AND ALL LIABILITIES, CAUSE OF ACTION, CLAIMS, DEMANDS,
COST ORDEBTS of any nature regardless of the cause, including the alleged NEGLIGENCE ofAQUA
HUNTERS KAYAK FISHING AND GUIDING SERVICES AND AQUA HUNTERSCLUB and AQUA
HUNTERS TOURNAMENTS, its owners, officers, agents,
employees, contractors, sponsors, and/or affiliated companies, for any injury and/or
death resulting from my participation in the sport and/or any use and/or transport ofany equipment and/or
gear associated with my engagement and/or participation in thesport, weather brought by me, my heirs,
executors or assigns, or by any third persons. Ifurther agree to defend, indemnify and hold harmless
AQUA HUNTERS KAYAKFISHING AND GUIDING SERVICES AND AQUA HUNTERS CLUB and
AQUAHUNTERS TOURNAMENTS, its owners, officers, agents, employees, contractors,
sponsors, and/or affiliated companies for any claims, lawsuits, damages, attorney fees,
costs, or judgments arising out of my participation in the sport and/or any use and/ortransport of any
equipment and/or gear associated with my engagement and/orparticipation in the sport, whether provided
by me or by AQUA HUNTERS KAYAKFISHING AND GUIDING SERVICES, AQUA HUNTERS CLUB, AQUAHUNTERS TOURNAMENTS and INNOVATIVE INTERNET & MEDIA SOULUTIONS, LLC.
I UNDERSTAND THAT THIS IS A RELEASE OF LIABILITY THAT IS VALID FOREVER,
and will apply whenever I participate in the sport and/or activities by and/or throughAQUA HUNTERS
KAYAK FISHING AND GUIDING SERVICES AND AQUA HUNTERSCLUB and AQUA HUNTERS
TOURNAMENTS, its owners, officers, agents,
employees, contractors, sponsors, and/or affiliated companies. I further understand
that this RELEASE OF LIABILITY will prevent me, my child and/or children, and/or myheir from filing a
lawsuit or making any claim for damages in the event of injury or
death to me from my participation in the sport and/or activities. Additionally, in theevent I file or my child
and/or children and/or heir or legal representative files a claim

or a lawsuit arising out of my participation in the sport and/or activities by and/orthrough AQUA HUNTERS
KAYAK FISHING AND GUIDING SERVICES AND AQUAHUNTERS CLUB and AQUA HUNTERS
TOURNAMENTS, its owners, officers, agents,
employees, contractors, sponsors, and/or affiliated companies, I AGREE TO DEFEND,
INDEMNIFY AND HOLD HARMLESS AQUA HUNTERS KAYAK FISHING ANDGUIDING SERVICES
AND AQUA HUNTERS CLUB and AQUA HUNTERSTOURNAMENTS, its owners, officers, agents,
employees, contractors, sponsors, and/
or affiliated companies for any damages, attorney’s fees or costs arising out of such aclaim or a lawsuit.
With a full understanding of this agreement, I nevertheless enter intothis agreement freely and voluntarily
and agree that it is binding upon me, my childand/or children, my heirs, assigns and legal representatives.
DISPUTE RESOLUTION/BINDING ARBITRATION: IN REGARD TO ANYRELATIONSHIP BETWEEN ME
AND AQUA HUNTERS KAYAK FISHING ANDGUIDING SERVICES AND AQUA HUNTERS CLUB and
AQUA HUNTERSTOURNAMENTS, ITS OWNERS, OFFICERS, AGENTS, EMPLOYEES,
CONTRACTORS, SPONSORS, AND/OR AFFILIATED COMPANIES THAT IS OR MAYBE CREATED BY
THE SIGNING OF THIS AGREEMENT, I AGREE THAT IF ANYDISPUTE ARISES OUT OF, OR
RELATES TO MY PARTICIPATION IN THE SPORTAND/OR ACTIVITIES, AND/OR ANY USE AND/OR
TRANSPORT OF ANYEQUIPMENT AND/OR GEAR ASSOCIATED WITH MY ENGAGEMENT AND/
ORPARTICIPATION IN THE SPORT, INCLUDING ANY SERVICES RENDERED BYAQUA HUNTERS
KAYAK FISHING AND GUIDING SERVICES AND AQUA HUNTERS
CLUB and AQUA HUNTERS TOURNAMENTS, ITS OWNERS, OFFICERS, AGENTS,
EMPLOYEES, CONTRACTORS, SPONSORS, AND/OR AFFILIATED COMPANIES ORANY OTHER
DISAGREEMENT OF ANY NATURE, TYPE OR DESCRIPTION,
REGARDLESS OF THE FACTS OR THE LEGAL THEORIES WHICH MAY BE
INVOLVED, SUCH DISPUTE SHALL BE RESOLVED BY BINDING ARBITRATIONBEFORE A
MUTUALLY AGREED UPON ARBITRATOR. I UNDERSTAND THAT BY
SIGNING THIS AGREEMENT, IF SUCH A DISPUTE OR ISSUE ARISES, BOTHMYSELF, MY CHILD OR
CHILDREN, AND/OR MY HEIR AND MY ATTORNEY WILLBE WAIVING ALL RIGHTS TO A TRIAL BY
JUDGE AND/OR JURY TO HAVE ANYDISPUTES AND/OR ISSUE(S) RESOLVED.

I understand and agree that this agreement is severable and
that if any clause is foundto be invalid, the balance of the contract will remain in effect and will be valid
andenforceable. I agree that any action will be brought in the County of Honolulu, State ofHawaii. I further
agree that any disputes will be subject to and determined under thelaws of the State of Hawaii.
Participants under the age of 18 years are required to have a parent or legal guardian read and sign this release.
